Italian Legislation on Online Betting and Gambling

Online betting and gambling are subject, in Italy, to laws and regulations that guarantee a safe and conscious gaming experience

Online gambling is now a widespread phenomenon also in Italy, where in recent years there has been a steady growth in game volume, reaching over 70 billion euro played on online betting, slot machines, online casino games and the like.

To make the online gambling industry safe and transparent at all times, the Italian Government issued special laws and regulations governing this market, also through the Customs and Monopolies Agency.

In particular, among the main objectives pursued by the Italian legislation on online betting and gambling is to provide the player with the information for a conscious gaming experience through authorised platforms, both with regard to the chances of winning and the risk of incurring diseases such as gambling addiction.

The online gambling laws, moreover, set the requirements to be met by operators who want to launch their own gaming platform on the market.

Such provisions are necessary to ensure that online betting and gambling are managed according to the rules and in total transparency: this allows the Government, on the one hand, to protect citizens and obtain the tax revenue owed by gambling companies, and on the other hand, to fight against the phenomenon of illegal gambling.

Online Betting: The Laws in Force

On this issue, one of the most important pieces of legislation is certainly Ministerial Decree No. 145 of 1 August 2022, issued by the Ministry of Economy and Finance, which repealed and replaced Ministerial Decree No. 111 of 1 March 2006, and which contains the regulation of fixed odds betting on sports events, with the definition of the general rules for online gambling.

In particular, Ministerial Decree No. 145/22 (which refers to special regulations adopted by the Customs and Monopolies Agency for the identification of the requirements to be met by operators licensed to provide the service) lays down precise rules regarding the validity of the bets (Article 6), the cases in which the player is entitled to a refund (Article 7), the criteria for determining winnings and bonuses allowed (Articles 10 and 11), taxes due and maximum winnings.

With regard to the latter issue, Article 14 of the aforementioned decree provides that “the acceptance of fixed odds bets whose potential winnings exceed fifty thousand euro is not allowed”.

Regarding online sports betting, it should also be mentioned that the so-called Dignity Decree (it. “Decreto Dignità”), Legislative Decree No. 87 of 2018, expressly banned the advertising of online betting sites, in order to protect consumers from the risks associated with gambling addiction.

The Regulation of Online Gambling in Italy

As for the Regulation of online gambling, mention should be made of the Ministry of Economy and Finance Decree of 10 January 2011, which identifies the rules on remote skill games and games of chance as well as card games.

This measure, in the wake of Legislative Decree No. 496/48, which reserves to the Government the activities of organising and exercising games and betting, provides for the general rules on how to play games, with or without jackpots, recalling the provisions of the Customs and Monopolies Agency’s regarding the gaming account required by the user to participate in the various games on each platform.

The aforementioned decree also lays down important provisions to protect players, both with regard to the anonymous processing of their personal data, and with regard to the licensed operators’ information obligations to them. Article 10 of the aforementioned decree, moreover, expressly provides that it must be the operator itself to promote responsible gaming behaviour on the part of the user, through specific communications on the platform.

Finally, on the subject of online betting and gambling legislation, it should be noted that with Art. 15 of Law No. 111 of 9 August 2023, the Government was delegated to implement the reorganization of existing provisions on public games, including remote ones.

      The online betting sector has been affected by recent regulatory measures in Italy governing cash out and value bets.

      The online betting sector on the sites of operators authorised by ADM (Customs and Monopolies Agency) has been affected by several legislative interventions in recent years, which have aimed to regulate the activities of bookmakers and promote safe and responsible gambling, both for the protection of bettors and for the guarantee of public interests in legality and transparency.

      In this regard, one of the most important regulatory interventions is represented by the Italian Ministerial Decree No. 145 of 1 August 2022, which introduced some important changes for both players and dealers.

      In particular, the measure adopted by the Minister of Economy and Finance introduced into our legal system the cash out mechanism, which was already widespread in the world of betting but, prior to Decree 145/22, was still lacking official regulation in Italy.

      According to the new rule (Art. 10 paragraph 8 of the aforementioned decree), the operator may propose to the participant the advance payment of a bet before the last of the predicted events takes place, offering them a certain amount of money as winnings, which the bettor is free to accept or deny. Obviously, this amount may be lower than the amount initially played.

      Those who have some practice with sports betting are familiar with the advantages of this option: for example, if the bettor has guessed the outcome of multiple events, they will, on the one hand, have the chance to cash out the entire winnings, should they also guess the last event contained in their bet. On the other hand, they will still be exposed to the possibility of losing their entire bet, should the last event not go as predicted.

      That is why the operator’s offer of an amount of money before the last match is played, even if it is less than the winnings shown on the bet receipt, may be the most attractive way to pocket a certain prize.

      The new betting win limit

      As part of the new betting regulations, an important novelty is also the increase in the maximum win limit from the previous 10,000 euros to 50,000 euros (Art. 14 paragraph 2 of the aforementioned Ministerial Decree).

      While those described so far may appear to be pro-bettor innovations, there is also an important novelty that serves the interests of betting companies, whose introduction has not been without controversy.

      This is the rule that protects operators in the event of clearly disproportionate odds, which in jargon are called value bets.

      It may happen, in fact, that the operator is mistaken in attributing odds to a given outcome, and this is particularly attractive for the bettor, because the probability of the outcome being achieved is greater than what the respective odds predict.

      Well, in this case, according to Art. 8 of the Ministerial Decree 145/2022, the dealer who detects an odds error for one or more outcomes of a bet contained in an already accepted participation receipt, may request ADM (the Customs and Monopoly Agency that manages the national betting totalizer) to recognise the odds error and consequently recalculate the odds.

      In conclusion, however, the fact that timely regulation of online betting has been introduced is to be welcomed by both operators and bettors, as this makes the world of betting safer, more transparent, and legal.

        Betting and gambling addiction, a new scandal for Italian football

        Several players from the Italian national team and Serie A are involved in an incident that will cost them months, if not years, of disqualification

        In the 1980s, football stadiums in several Italian cities became the stages for a surreal scene: police vans practically burst onto the field to arrest certain players involved in an underground betting scandal.

        Forty years later, this scene seems to be repeating itself, with a modern twist that makes it even more worrying in some ways. Apparently, the world of football is once again caught up in a scandal, but this time the problem is online betting, not match-fixing. What’s worse, it seems that many of the younger participants – mostly in their twenties or so – are actually developing severe gambling addictions.

        This time there were no vans, but when the Guardia di Finanza agents showed up at the technical headquarters in Coverciano to deliver an investigation notice to the players Sandro Tonali and Nicolò Zaniolo, in the middle of preparations with the Italian national team for an important European qualifying match the following year, it became clear to everyone that another storm was brewing around Italian football.

        A few hours later, it was learned that Nicolò Fagioli, a promising young player for Juventus, was also under investigation.

        The Italian media is still producing a steady stream of news that, day after day, involves new players of suspected or confirmed guilt, based on revelations by third parties in pursuit of sensationalism, such as the controversial photographer-entrepreneur Fabrizio Corona.

        Sports legislation states that Italian cardholding members cannot bet on sporting events except on authorised platforms, where each operation remains traceable.

        The ongoing investigations, which apparently concern a wide circle of prominent footballers, are outlining a worrying picture: bets placed on clandestine platforms, with tricks to avoid any data traceability.

        Some of the players involved – such as Fagioli, who voluntarily reported himself to the police – appear to have accumulated millions of euros in debt, victims of gambling addiction.

        Illegal betting: how to recognise legal online platforms

        At any level, illegal betting must always be condemned, because those managing it operate without rules, with dirty money, and are devoid of any responsibility or control by current regulations.

        When we talk about rules, we don’t mean that this is merely a tax issue. The regulation of online gambling and betting is also aimed at ensuring that platforms are under the supervision of public authorities and fall within national jurisdiction. Only authorised ADM (the Italian Customs and Monopolies Agency) platforms guarantee a service in accordance with the law.

        At its core, this isn’t just about preventing obscure intermediaries (who are almost always linked to organised crime) from replacing legitimate companies that operate legally with complete transparency. It is mostly about raising public awareness of the risks and dangers this seemingly innocent pastime can entail when it transforms into an addiction, a true disease that is capable of ruining lives.

        These footballers, who have already tasted success and signed contracts in the millions, do not appear to have rigged any matches, at least not at this point in the investigation. They have simply spiralled out of control from a life that has become too easy, with a boredom that can only be assuaged by filling their time off the field with an invigorating and potentially lucrative activity.

        Betting is a game that must walk a fine line, with a need for legality, transparency, and protection for the players themselves, but this new scandal with Italian football tells us that this is not enough: we cannot forget that in addition to talent, success, and money, there are still plenty of other values needed to grow up.

        It is a matter of education and culture, long before it becomes an issue of legality. While the responsibility may superficially lay with these football players, it has actually uncovered a much deeper problem that concerns all of society.
